Notes for Capt. John Heaton:
CAPTAIN JOHN HEATON, a retired farmer residing in Virginia, Cass county, Illinois, was born in Wigan, Lancashire county, England, January 1, 1810.

Dennis Heaton, his father and Bartley Heaton, his grandfather, were also natives of Wigan, the family as far as known being of English ancestry. Grandfather Heaton was a Colonel in the Life Guards. He spent his whole life in England. Dennis Heaton was engaged in the mercantile business in Wigan, where he died about 1816. The maiden name of his wife was Kate Bartley, and she, too, was a native of Wigan. After the death of Mr. Heaton she married James Richardson. Her death occurred in Yorkshire about 1852. By her first husband she had nine children, all of whom reached adult years; by her second husband she reared four children.

The subject of our sketch was reared in Manchester. He was six years old when his father died, and from the time he was seven he earned his own living. From his seventh year till his thirteenth he worked in a cotton factory, after which he began learning the trade of tin and coppersmith with Mr. Moon in Oldham street, Manchester, with whom he worked seven years. He now has a kettle which he made in 1827 and presented to his mother. At the time of his marriage she gave it back to him, and it has been in daily use in his family ever since.

At the age of twenty-one Mr. Heaton enlisted in the Thirty-sixth Regiment of Infantry, and was soon transferred to the Fifty-ninth Regiment, and marched across Ireland to Dublin, joining the regiment at Port Aa Bella Barracks, and served two years and eight months. He was in different parts of Ireland ten months and then made a forced march to Oldham, England, to quell a riot there; thence to Liverpool, where he embarked for Gibraltar, a year later to Malta, then to Carfew, and from there back to Gibraltar, where his discharge and that of nineteen others was purchased, supposed to have been by the Spanish Government. He then became a member of Shaw's brigade for the Spanish army during the war between Don Carlos and the Queen; was commissioned Captain of the Light Company and commanded that company in the different marches, battles, etc. incident to that war. He served a little more than seven years.

When peace was declared Captain Heaton was honorably discharged and returned to Manchester. There he began business on his own account as a tin and copper smith, remaining thus occupied until 1850. That year he came to America, sailing from Liverpool on the 27th of May and landing in Quebec after a voyage of seven weeks and three days. His father-in-law was at that time living four miles from Streetsville, Ontario. He joined him, and from there visited the Queen's Bush, a tract of timber land set aside for the soldiers. Not caring to have a farm in the wilderness, he came to the United States. After residing in St. Louis a few weeks, he sought a home in Cass county, Illinois, taking up his abode seven miles from Virginia, where he entered a tract of Government land. He erected a log house and commenced at once to improve his land. This was before the coming of the railroad and when Beardstown was the principal market for this section of the country. Deer and various kinds of wild game were plenty here. Captain Heaton improved fifty acres of land, and in 1854 sold it to John Fravey. He then moved to Beardstown in order to give his children the benefit of schools. He was employed by Horace Billings in his pork house for a time, and later was in the employ of Mr. Crea and Henry Chatsey. While a resident of that place he was sent for from Brooklyn, New York, to superintend a pork-packing establishment there for a Mr. Arris. He remained in Brooklyn one season. In 1863 he went to Decatur, Illinois, and established a packing house for Mr. Plato. He subsequently purchased a farm of Major Arnold, in Monroe precinct, and resided on it till 1870. The following two years he lived in Beardstown. His next move was to Virginia. He bought property on Gospel Hill, built a house, and resided there till 1884. He then rented that place, and bought and moved to his present home.

Captain Heaton was married at Bolton, Lancashire, England, November 2, 1840, to Mary J. Fullerton. She was born in the Tower of London, February 29, 1820, daughter of Major James Fullerton, a native of England. When a young man, her father enlisted in the Seventh Battalion, and was commissioned Major. He was in command of the tower at the time of her birth. He served in the army about twenty-two years, after which he was retired on half pay. He then emigrated to Canada, and settled twenty miles from Toronto, Ontario, where he bought a farm and resided till his death. The maiden name of his wife was Martha Glen. She was born in England and died in Canada.

To Captain Heaton and his wife eleven children have been born, viz.: Noble John, who was married by W. R. Whitehead to Flavila Yaple, December 24, 1873, and has three children, Charlie, Alford and Noble John; Catharine, who was married by R. C. H. Heimerling to Charles Caldwell, December 12, 1860, and has seven children, Patrick, John, Emma, Jennie, who became the wife of James Mead, of Virginia; Lizzie, Katie and Edward; Edward, who lost his life in a railroad accident on the Central Pacific Railroad; James, who was married in November, 1873, to Cora Seaman, has one child, Florence; Mary Jane, who was married by Benjamin Williams to W. B. Williams, August 7, 1871, and has two children, Eddie and Henry; William, who was married by John W. Shay to Hannah E. Seaman, November 10, 1875, and has five children, Mary, John, Willard, George and Eva; Charles, who was married January 5, 1885, to Sadie Bohman; Susan, who was married by John W. Allen to Reuben Lancaster, March 11, 1880, and has two children, Earl and Iva; Alice, who was married by John W. Allen to Edward E. Savage, May 10, 1877, and has four children, Henry, Walter, Bessie and Zella; Martha, who was married by J. E. Roach to Richard H. Payne, November 20, 1884, and has four children, Carey, Inis, Hazel and Irine; and Thomas, who is unmarried. They have twenty-nine grandchildren and three great-grandchildren.

The Captain and his worthy companion are devout members of the Catholic Church.

The sword which this veteran carried in Spain he has presented to his son, Noble John, who values it beyond price.

Such is a brief record of one of Virginia's pioneers and highly respected citizens.

Last Monday, Phineas Underwood was struck by a tree and died a short time later. He was 85 years old. Three children survive, Rachel Anderson of here, Susan Cowan, who resides on the homestead, and Thomas Underwood, of Missouri. He was a Mason for 60 years and a member of the Methodist E. Church. He buried in Powell Cemetery. (Thomas is buried in Walnut Ridge Cemetery in Virginia, IL.)

UNDERWOOD, Phineas, Virginia Enquirer, October 14, 1909
Phineas Underwood was born in the year 1763 in Vermont. His father and two brothers had served in the American Revolution and when Phineas was eighteen, he enlisted at Putney, Vermont, in March, 1781, serving under Josiah Fish. He served ten months. As a widower in 1826, he came to Illinois with his son, Phineas, Jr. and family, headed for the Military Tract between the Illinois and Mississippi rivers, where he intended to enter government land with his soldier land warrant. While passing through Morgan County, he was so pleased with the land here that he concluded his journey, going no futher. On November 24, 1826, he settled two and one half miles northwest of Virginia, in Cass County. The Underwoods came ten years before Dr. Hall laid out the town of Virginia, in Cass County. The old soldier lived on this land until 1844 when he died at the age of eighty one, leaving a son, Phineas, Jr., and a daughter, Rachel. The body was laid to rest in the old Halsey Smith burial ground, three miles west of Virginia. Phineas Underwood, Jr., his wife, and one of their sons were also buried in this old cemetery. Other members of the family were interred nearby, buy when a granddaughter, Rachel Anderson, died April 3, 1901, at the age of sixty-seven, her children purchased a lot in Walnut Ridge cemetery in Virginia. The children of Rachel Anderson consented to the body being removed to that plot. The head of the DAR in Springfield, IL manifested a great interest in his removal and agreed to apply for a U.S. Government marker for the grave. The Virginia GAR contributed to the cost of the removal. The remains now lie in Walnut Ridge cemetery. (Halsey Smith cemetery is better known as Powell cemetery.)

"First: she gave a young mare to her granddaughter Eliza Ann Samuell. Second: she gave all her household and kitchen furniture to her grandson Thomas A Samuell and all her stock (hogs, cattle, etc.). Third: Her interest in negro Daniel to be equally divided between her son Isaac Mitchell (Jr) and her two daughters, Elizabeth Taylor and Sarah Redd Samuell. Thomas A Samuell executor."

Elizabeth Ayers Stribling emigrated to Morgan Co, Illinois in the Fall of 1827 with her son Benjamin and his family. In 1830 they moved to Cass Co, Illinois near (N. West of) the town of Virginia. She is buried in the Stribling family graveyard on the farm owned by her son Benjamin at the time of her death. Eventually all of her other living children, Milly Martin Stribling Horn, Frances Stribling Mitchell, and William Cohely (Colclough) Stribling became residents of central Illinois. Joel died in Logan Co, KY 4-22-1826.

Joseph Underwood was born in Reading in 1681 and died in Westford in 1761. He was one of the original settlers of Westford Center and owned a tract of land on the easterly side of Tadmuck Hill. His home was near the intersection of Leland Road and Main Street. He appears in the Chelmsford Town Records as early as 1724 when he was a petitioner from the “new parish” seeking a schoolmaster who could also preach. “He was one of the original members of the first church; was active in all public affairs, and was evidently a man of character and influence. On September 9th 1832 when he made his declaration of service he stated he was living in Surry County, North Carolina at the time he was called and has resided in the same neighborhood since the end of the war.

He was first drafted for a three month term in the late summer of 1780. He served under Captain Edwin Hickman and his brother Lt. Thomas Hickman. They marched to Old Moravin Town, and then to the courthouse in Old Richmond, then to Shallowford of the Yadkin River and continued marching until they were within 10 miles of battleground of King's Mountain. There they met the troops that had just defeated the British and Tories. That was October 7, 1780. They assumed control of the POWs and marched them to Old Moravin Town."

Introduction

As is the case in many New England communities, the Westford town land presently known as the "common" was once set aside as a training field for the local militia. So important (and indeed, required) was service in the local militia, that town resources were expended in acquiring sufficient land for training and practice of their martial skills. While peacetime saw such gatherings occur only three or four times each year, the frequency increased significantly during times of conflict, such as the months leading up to the outbreak of hostilities between Britain and her colonies. Those who were required to muster were ordinary townsmen, and as such, were not always the most capable military men. It was nevertheless expected, as ones civic duty, to be prepared to defend the community in times of need. One of these calls to muster on the "Common trainingfield" can be found in the 1772 letter from Zaccheus Wright, the town clerk, to corporal William Hildreth of Capt. Jonathan Minot's company.

The following sections provide a transcript of the original 1748 deed, detailing the purchase of land in the town center for the purposes of a militia training field. The original document is on display at the Westford Museum. In addition, excerpts from the town records which relate to this purchase and later expansion of the town common are outlined. Finally, some biographical information on the principle figures in the transaction is provided.

To all People to whom these Presents shall come, Greeting. Know ye that I Joseph Underwood of Wesford in the County of Middlesex in his Majesty’s Province of the Massachusetts Bay in New England, Husbandman: For & in Consideration of the sum of Twenty Pounds in Bills of Public Credit of ye old Tenor to me in hand before the ensealing hereof well and truly paid by Capt. Thomas Read, Lieut. Jonas Prescot, Junr. & Mr. John Abbott all of sd Wesford and all a Commtee chosen by sd Town, May The Twenty first, 1744 Bot. of sd Underwood a piece of Land for the convenience of a Training Field, as by sd vote will mo fully appear) The Receipt whereof I hereby acknowledge & myself herewith fully satisfied & contented, & whereof & of every part & parcel thereof, do exonerate, acquit & discharge them the sd Capt. The Town Records provide the following entries pertaining to the purchase of what is now Westford Common [spelling and capitalization per the original records]:

An old undated newspaper article states of the Common that:

Prior to 1744 this land was owned by Joseph Underwood. It may have been called waste land as the public traveled over it in any direction , although, according to tradition, there was a highway through the center of it.

In 1893, through the kindness of the late John M. Fletcher, who turned over to the selectmen the deed to the common which he found in some old papers that came into his hands, the selectmen found that there was no record of it in the registry of deeds office. It was then recorded in the Middlesex north district registry of deeds office, Book 240, page 127.

John Marion Fletcher (1846-1923), mentioned above, was a postmaster in Westford for many years and also served in many town offices. He was the son of John Bateman Fletcher (1802-1888), who lived on the south side of the Common at 4 Lincoln Street and was the owner/proprietor of the J. B. Fletcher’s store located next to his home at 6-8 Lincoln Street.

Men of Distinction

The men mentioned in the deed were all prominent in the early history of Westford. Joseph Underwood, Thomas Read, Jonas Prescott, and Ephraim Craft all appear on Westford’s first Tax List, c. 17291. Capt. Read and Lt. Prescott were probably leaders of Westford’s Train Band, the name then use for the local town militia which would be the principal users of the new Training Field.

Joseph Underwood was born in Reading in 1681 and died in Westford in 1761. He was one of the original settlers of Westford Center and owned a tract of land on the easterly side of Tadmuck Hill. His home was near the intersection of Leland Road and Main Street. He appears in the Chelmsford Town Records as early as 1724 when he was a petitioner from the “new parish” seeking a schoolmaster who could also preach. “He was one of the original members of the first church; was active in all public affairs, and was evidently a man of character and influence. He was a farmer and innholder, and owned a large tract of land on the eastern slope of the hill on which the Central Village now stands, reaching up to the Common… It was the best land near the centre… His dwelling stood nearly opposite Mrs. Leland’s, where a cellar-hole yet remains [near 1 Leland Road where that road now enters Main Street].”2

Thomas Read was born in 1687 and was also an original settler of Westford. His farm was on the northwesterly side of Francis Hill, his house located at the northwest corner of the intersection of Stony Brook and Lowell Roads. Thomas Read served in a snow-shoe militia company in Chelmsford during Dummer's War in 1723-24. He was elected “fifth Selectman” at the first Town Meeting held March 2, 1729-30. In 1734 Joseph Underwood and Capt. Thomas Read were chosen to work with men from other towns in establishing Middlesex County. He died in Westford in 1773.

Jonas Prescott was born in Forge Village in 1703; both his father and grandfather were also named Jonas. His grandfather was a blacksmith in Groton and built an iron foundry in Forge Village where his father then settled. His home was located on the north side of W. Prescott Street just to the east of the present baseball fields. Jonas Prescott died in Westford in 1784.

John Abbot was born in Billerica in 1713, the son of Deacon John Abbot. He joined the church in Westford in 1735 and was chosen deacon in 1762. “He was a school teacher, town clerk, and selectman for many years. He lived in the centre of the town.”3

The first witness to the deed, Rev. Willard Hall (1703-1779), was the first pastor of First Parish Church, serving from its inception in 1727 until his death in 1779. He was born in Medford, Mass., and graduated from Harvard College in 1722. He also ran a small farm situated to the north and east of the church along Main Street. His home, one of the earliest in Westford Center, was located near the site of the J. V. Fletcher Library. During the Revolutionary War, Rev. Hall’s loyalty diverged from that of the vast majority of his congregation. One of only three Loyalists in Westford, he “remained steadfast in his loyalty to the king until he died, in 1779.”4

The other witness, Ephraim Craft, lived near the site of 3 Depot Street. He came to Westford before 1730 from Roxbury, Mass., where he was born in 1701.


Notes on the Original Document

When the deed was preserved at the Northeast Document Conservation Center in Andover, Mass., in the summer of 1999, the paper on which the deed was written was found to have a watermark dated 1742 consisting of a crown with two supporting lions. The paper was undoubtedly made in England and imported to the Province of Massachusetts Bay.

The brownish ink used for the deed was probably made from iron oak gall. The seal was made of beeswax with vermilion coloring and sealed with shellac.

One genealogy, crudely written in longhand by F.F. Crowell (not dated), numbered No. 571 and titled New Englanders in Nova Scotia where some descendants of Joseph Underwood ended up, states that: "Joseph (1) Underwood, born in London, England, about 1615, was the immigrant to America. He is said to be the son of John and Rachel (Edwards) Underwood, and a grandson of Joseph Underwood, of Dorchester, England. Joseph and his brother, Thomas Underwood on their arrival in New England, settled at Hingham, Mass., but removed to Watertown, Mass., in 1645.
Joseph Underwood died in Watertown, Feb. 16, 1676, aged about 62 years. Good wife Underwood `dyed the 28, 11 mo 1667.' "

Christopher's will states: I bequeath my body to the earth to be buried before the Chappell of Ease at the Old Plantation Creek. A generation later it was found an order to Capt. John Mason, High Sheriff,to treat Indian affairs. Mentioned were Ensign Joel Stribling of the English Navy and Col. John Stripling
